    Divorce Overview in California

    California Family Code §2300 defines divorce, or dissolution of marriage as restoring the party's state to unmarried persons. This means that divorced couples regain single status. But, divorce can have significant and far-reaching consequences regarding your rights and duties.

    But first, you must meet California's residency requirements which state that one of the spouses must be a resident of California for at least six months and of the filing County for at least three months. Moreover, the spouses must wait for at least six months before the divorce is finalized.

    California is a no-fault state, which means that the petitioning spouse doesn't need to prove wrongdoing to get divorced. They may simply cite irreconcilable differences or legal incapacity, and divorce will be finalized even if the other spouse doesn't want it.
